Introduction
Welcome to zkPass. zkPass provides access to a decentralized protocol and suite of applications (“Services”) designed to enable users to generate privacy-preserving verifiable proofs of data ownership and authenticity using zero-knowledge cryptography and 3P-TLS technologies. These proofs allow users to validate claims about data retrieved from third-party HTTPS sources without disclosing the underlying data itself. Supported data types may include—but are not limited to—identity documents, financial activity, academic records, employment history, social behavior, and skill certifications.
Please read these Terms and Conditions (“Terms”) carefully before using the zkPass website or any affiliated services (collectively, the “Site”). By accessing or using the Site or Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site or Services.
Acceptance of Terms
By accessing, browsing, or using the Site or Services, you represent that you are legally competent to enter into a binding agreement and that you accept and agree to be bound by these Terms, together with any additional policies, notices, or disclaimers published on the Site. If you do not meet these conditions or do not agree to these Terms, you must refrain from using the Site or Services.
User Data
zkPass is a non-custodial protocol. It does not access, store, or process any personal data or zero-knowledge proofs generated by users. All cryptographic operations are performed locally on the user’s device or browser. Users remain solely responsible for managing their keys, proofs, and any data submitted or derived through the protocol.
zkPass makes no representations or warranties regarding the persistence, accuracy, or security of user-managed data or generated proofs.
Privacy Policy
zkPass is designed with a privacy-first architecture and does not collect or retain any personally identifiable information (PII). However, use of the Site (e.g., web traffic, access logs, browser metadata) may be subject to third-party analytics providers or hosting infrastructure. Intellectual Property
All content, trademarks, logos, source code, protocol specifications, documentation, user interfaces, and any other intellectual property (collectively, the “Materials”) available on or through the Site or Services are the property of zkPass or its licensors and are protected by applicable intellectual property laws and treaties.
Subject to these Terms, zkPass grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Materials solely for personal, non-commercial purposes. Any unauthorized use—including but not limited to copying, reproducing, modifying, distributing, decompiling, or reverse-engineering the Materials—is strictly prohibited and may result in civil or criminal liability.
User Conduct
You agree to use the Site and Services only in compliance with applicable laws and regulations and in accordance with these Terms. You shall not:
Access, tamper with, or use non-public areas of the Site or its infrastructure;
Interfere with or disrupt any network, system, protocol, or third-party services connected to zkPass;
Introduce viruses, malware, or other malicious software or code;
Impersonate any person or misrepresent your affiliation;
Use the protocol in any manner intended to circumvent security measures or exploit economic incentives in bad faith.
zkPass reserves the right to investigate and take appropriate legal action in response to any violation of these Terms.
Third-Party Links and Content
The Site may contain links to or content from third-party websites or services that are not owned or controlled by zkPass. zkPass does not endorse or assume any responsibility for such third-party content, services, or practices. Accessing or relying on any third-party material is done at your own risk, and zkPass disclaims all liability arising therefrom.
Disclaimer of Warranties
The Site and Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, zkPass disclaims all warranties, including but not limited to:
Warranties of merchantability, fitness for a particular purpose, or non-infringement;
Warranties regarding the accuracy, reliability, availability, or security of the Site or Services;
Warranties that the Services will be uninterrupted, error-free, or immune from cyberattacks or other vulnerabilities.
Limitation of Liability
To the maximum extent permitted by applicable law, zkPass, its affiliates, officers, employees, contractors, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Site or Services, whether based in contract, tort, strict liability, or otherwise.
In no event shall the total liability of zkPass exceed the amount paid by you, if any, for accessing or using the Services during the twelve (12) months preceding the claim.

Due to regulatory constraints and the varying legal status of blockchain technology and digital currencies across different jurisdictions, zkPass restricts the availability of its services to the countries and regions specifically listed. Access to and use of our services from any country or region not explicitly supported is prohibited. This ensures compliance with international legal standards and local regulatory frameworks governing the deployment and use of blockchain-based applications and digital currencies.
Use of Protocols
Certain zkPass protocol operations—such as those involving 3P-TLS, zero-knowledge proof generation, or threshold signatures—may require the consumption of computational or cryptographic resources (“Compute Gas Fees”). These fees may be incurred by users (also referred to as “Provers”) under specific conditions and are typically analogous to gas costs on Layer 2 blockchain networks.
In some cases, zkPass or its ecosystem partners may act as a paymaster (e.g., via ERC-4337) and cover such fees to lower the barrier to participation. This may occur during promotional campaigns, beta testing, or community initiatives.
The purpose of these fees is to ensure fair use of system resources, support long-term sustainability of the protocol, and mitigate Sybil attacks and fraudulent activity (e.g., repeated attestations from multiple addresses or attempts to exploit reward mechanisms).
Modifications to Services and Terms
zkPass reserves the right to modify, suspend, or discontinue any part of the Site, Services, or Protocol (including but not limited to technical features, pricing models, supported data types, or access methods) at its sole discretion and without prior notice.
zkPass may also update these Terms from time to time. Any changes will become effective upon publication. Your continued use of the Site or Services following any modification constitutes your acceptance of the revised Terms. You are encouraged to review the Terms periodically to stay informed of any updates.
Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Services, including any questions regarding their existence, validity, or termination, shall be resolved through binding arbitration in accordance with the rules of the jurisdiction where zkPass is incorporated or operates its principal business activities. The arbitration shall be conducted in English and seated in a mutually agreed jurisdiction.
By using the Site or Services, you waive the right to a trial by jury or to participate in a class action lawsuit, to the extent permitted by law.
Entire Agreement
These Terms, along with any policies, guidelines, or notices referenced herein, constitute the entire agreement between you and zkPass with respect to the subject matter hereof and supersede all prior or contemporaneous communications, whether oral or written. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
